BEIJING (AP) ? Two Shanghai men have died from a lesser-known type of bird flu in the first known human deaths from the strain, and Chinese authorities said Sunday that it wasn't clear how they were infected, but that there was no evidence of human-to-human transmission.
A third person, a woman in the nearby province of Anhui, also contracted the H7N9 strain of bird flu and was in critical condition, China's National Health and Family Planning Commission said in a report on its website.
There was no sign that any of the three, who were infected over the past two months, had contracted the disease from each other, and no sign of infection in the 88 people who had closest contact with them, the medical agency said.
H7N9 bird flu is considered a low pathogenic strain that cannot easily be contracted by humans. The overwhelming majority of human deaths from bird flu have been caused by the more virulent H5N1, which decimated poultry stocks across Asia in 2003.
The World Health Organization is "closely monitoring the situation" in China, regional agency spokesman Timothy O'Leary said in Manila.
"There is apparently no evidence of human-to-human transmission, and transmission of the virus appears to be inefficient, therefore the risk to public health would appear to be low," O'Leary said.
One of the two men from Shanghai, who was 87, became ill on Feb. 19 and died on Feb 27. The other man, 27, became ill on Feb. 27 and died on March 4, the Chinese health commission said. A 35-year-old woman in the Anhui city of Chuzhou became ill on March 9 and is being treated.
The Chinese Center for Disease Control and Prevention conducted tests and confirmed Saturday that all three cases were H7N9, the health commission said.
Scientists have been closely monitoring the H5N1 strain of the virus, fearing that it could mutate into a form that spreads easily among people, potentially sparking a pandemic. So far, most human cases have been connected to contact with infected birds.

Restaurant operators remain generally optimistic about sales growth and the economy in the months ahead
?The Restaurant Performance Index decline was due largely to softer sales and traffic results, which fell in February amid higher gas prices and the impact of the payroll tax hike,? said Hudson Riehle, senior vice president of the Research and Knowledge Group for the Association. ?In addition, sales and traffic comparisons were more difficult due to the extra day in February 2012 as a result of Leap Year.?
?Despite the sales and traffic declines in February, restaurant operators remain generally optimistic about business conditions in the months ahead, which suggests they feel the setbacks will be temporary,? Riehle added.
The RPI is constructed so that the health of the restaurant industry is measured in relation to a steady-state level of 100. Index values above 100 indicate that key industry indicators are in a period of expansion, while index values below 100 represent a period of contraction for key industry indicators. The Index consists of two components ? the Current Situation Index and the Expectations Index.
The Current Situation Index, which measures current trends in four industry indicators (same-store sales, traffic, labor and capital expenditures), stood at 98.3 in February ? down 1.4 percent from January?s level. In addition, the Current Situation Index stood below 100 for the 6th consecutive month, which signifies contraction in the current situation indicators.
With sales comparisons more difficult in February due to Leap Year in 2012, restaurant operators reported a same-store sales decline for the first time in 21 months. Thirty-three percent of restaurant operators reported a same-store sales gain between February 2012 and February 2013, while 48 percent of operators reported lower sales. In January, 44 percent of operators reported higher same-store sales, while 37 percent reported a sales decline.
Restaurant operators also reported a decline in customer traffic levels in February. Twenty-four percent of restaurant operators reported higher customer traffic levels between February 2012 and February 2013, while 53 percent of operators said their traffic declined. In January, 33 percent of operators reported an increase in customer traffic, while 40 percent reported lower traffic levels.
Capital spending activity also dipped along with the sales and traffic results. Forty-eight percent of operators said they made a capital expenditure for equipment, expansion or remodeling during the last three months, down from 52 percent who reported similarly last month.
The Expectations Index, which measures restaurant operators? six-month outlook for four industry indicators (same-store sales, employees, capital expenditures and business conditions), stood at 101.4 in February ? down slightly from January?s level of 101.6. Each of the four expectations indicators stood above 100 for the second consecutive month, which suggests restaurant operators remain generally optimistic about business conditions in the months ahead.
Although restaurant operators? outlook for sales growth remains positive, their expectations are slightly less bullish compared to last month. Forty-one percent of restaurant operators expect to have higher sales in six months (compared to the same period in the previous year), down from 46 percent last month. Meanwhile, 14 percent of restaurant operators expect their sales volume in six months to be lower than it was during the same period in the previous year, compared to 17 percent last month.
Although restaurant operators have a net positive outlook for the overall economy for the second consecutive month, their confidence is tenuous. Twenty-five percent of restaurant operators said they expect economic conditions to improve in six months, down from 30 percent who reported similarly last month. Meanwhile, 20 percent of operators said they expect economic conditions to worsen in the next six months, unchanged from last month.
Restaurant operators continue to make plans for capital spending in the months ahead. Fifty-seven percent of restaurant operators plan to make a capital expenditure for equipment, expansion or remodeling in the next six months, down slightly from 59 percent who reported similarly last month.
The RPI is based on the responses to the National Restaurant Association?s Restaurant Industry Tracking Survey, which is fielded monthly among restaurant operators nationwide on a variety of indicators including sales, traffic, labor and capital expenditures. One may indeed be the loneliest number, but being number one certainly has its advantages ? up to half a million of them, if this past weekend?s sale of the very first 1957 Cadillac Eldorado Biarritz at $649,000 is any indication.
Assigned engine #000001, which makes it VIN #000001, the Biarritz also wears body #000001, painted a shade of green that Cadillac reportedly applied to the first production Cadillac of the year during the 1950s. Jim Remlinger, who consigned the Biarritz with the Hollywood Wheels Palm Beach Auction, said that he verified the combination of VIN and body number through Cadillac Historical Services, which provided a copy of the build sheet and the original title showing all three numbers.
Remlinger said he bought the car about two years ago and tore it down for a complete restoration, finding several non-production items on the car, including hand-fabricated moldings, some 1956 parts, and the word ?sample? stamped in the frame. Unfortunately, his research never turned up who originally owned the car or any of its history up to about 1959.
The Biarritz and its hardtop equivalent, the Seville, debuted in 1956, but for 1957 Cadillac introduced the oftentimes polarizing chipmunk cheeks rear end and bumped the output of the dual-quad 365-cu.in. V-8 from 305 to 325hp. While the Eldorado Biarritz is generally considered to be the most valuable 1957 Cadillac, price guides generally assign perfectly restored examples a value between $150,000 and $250,000.

The last U.S. combat troops left Vietnam 40 years ago Friday, and the date holds great meaning for many who fought the war, protested it or otherwise lived it.
While the fall of Saigon two years later is remembered as the final day of the Vietnam War, many had already seen their involvement in the war finished ? and their lives altered ? by March 29, 1973.
U.S. soldiers leaving the country feared angry protesters at home. North Vietnamese soldiers took heart from their foes' departure, and South Vietnamese who had helped the Americans feared for the future.
Many veterans are encouraged by changes they see. The U.S. has a volunteer military these days, not a draft, and the troops coming home aren't derided for their service. People know what PTSD stands for, and they're insisting that the government takes care of soldiers suffering from it and other injuries from Iraq and Afghanistan.
Below are the stories of a few of the people who experienced a part of the Vietnam War firsthand.

'MORE INTERESTED IN GETTING BACK'
Dave Simmons of West Virginia was a corporal in the U.S. Army who came back from Vietnam in the summer of 1970. He said he didn't have specific memories about the final days of the war because it was something he was trying to put behind him.
"We were more interested in getting back, getting settled into the community, getting married and getting jobs," Simmons said.
He said he was proud to serve and would again if asked. But rather than proudly proclaim his service when he returned from Vietnam, the Army ordered him to get into civilian clothes as soon as he arrived in the U.S. The idea was to avoid confrontations with protestors.
"When we landed, they told us to get some civilian clothes, which you had to realize we didn't have, so we had to go in airport gift shops and buy what we could find," Simmons said.
Simmons noted that when the troops return today, they are often greeted with great fanfare in their local communities, and he's glad to see it.
"I think that's what the general public has learned ? not to treat our troops the way they treated us," Simmons said.
Simmons is now helping organize a Vietnam Veterans Recognition Day in Charleston that will take place Saturday.
"Never again will one generation of veterans abandon another. We stick with that," said Simmons, president of the state council of the Vietnam Veterans of America. "We go to the airport. ... We're there when they leave. We're there when they come home. We support their families when they're gone. I'm not saying that did not happen to the Vietnam vet, but it wasn't as much. There was really no support for us."

A RISING PANIC
Tony Lam was 36 on the day the last U.S. combat troops left Vietnam. He was a young husband and father, but most importantly, he was a businessman and U.S. contractor furnishing dehydrated rice to South Vietnamese troops. He also ran a fish meal plant and a refrigerated shipping business that exported shrimp.
As Lam, now 76, watched American forces dwindle and then disappear, he felt a rising panic. His close association with the Americans was well-known and he needed to get out ? and get his family out ? or risk being tagged as a spy and thrown into a Communist prison. He watched as South Vietnamese commanders fled, leaving whole battalions without a leader.
"We had no chance of surviving under the Communist invasion there. We were very much worried about the safety of our family, the safety of other people," he said this week from his adopted home in Westminster, Calif.
But Lam wouldn't leave for nearly two more years after the last U.S. combat troops, driven to stay by his love of his country and his belief that Vietnam and its economy would recover.
When Lam did leave, on April 21, 1975, it was aboard a packed C-130 that departed just as Saigon was about to fall. He had already worked for 24 hours at the airport to get others out after seeing his wife and two young children off to safety in the Philippines.
"My associate told me, 'You'd better go. It's critical. You don't want to end up as a Communist prisoner.' He pushed me on the flight out. I got tears in my eyes once the flight took off and I looked down from the plane for the last time," Lam recalled. "No one talked to each other about how critical it was, but we all knew it."
Now, Lam lives in Southern California's Little Saigon, the largest concentration of Vietnamese outside of Vietnam.
In 1992, Lam made history by becoming the first Vietnamese-American to elected to public office in the U.S. and he went on to serve on the Westminster City Council for 10 years.
Looking back over four decades, Lam says he doesn't regret being forced out of his country and forging a new, American, life.
"I went from being an industrialist to pumping gas at a service station," said Lam, who now works as a consultant and owns a Lee's Sandwich franchise, a well-known Vietnamese chain.
"But thank God I am safe and sound and settled here with my six children and 15 grandchildren," he said. "I'm a happy man."

ANNIVERSARY NIGHTMARES
Wayne Reynolds' nightmares got worse this week with the approach of the anniversary of the U.S. troop withdrawal.
Reynolds, 66, spent a year working as an Army medic on an evacuation helicopter in 1968 and 1969. On days when the fighting was worst, his chopper would make four or five landings in combat zones to rush wounded troops to emergency hospitals.
The terror of those missions comes back to him at night, along with images of the blood that was everywhere. The dreams are worst when he spends the most time thinking about Vietnam, like around anniversaries.
"I saw a lot of people die," Reynolds said.
Today, Reynolds lives in Athens, Ala., after a career that included stints as a public school superintendent and, most recently, a registered nurse. He is serving his 13th year as the Alabama president of the Vietnam Veterans of America, and he also has served on the group's national board as treasurer.
Like many who came home from the war, Reynolds is haunted by the fact he survived Vietnam when thousands more didn't. Encountering war protesters after returning home made the readjustment to civilian life more difficult.
"I was literally spat on in Chicago in the airport," he said. "No one spoke out in my favor."
Reynolds said the lingering survivor's guilt and the rude reception back home are the main reasons he spends much of his time now working with veteran's groups to help others obtain medical benefits. He also acts as an advocate on veterans' issues, a role that landed him a spot on the program at a 40th anniversary ceremony planned for Friday in Huntsville, Ala.
It took a long time for Reynolds to acknowledge his past, though. For years after the war, Reynolds said, he didn't include his Vietnam service on his resume and rarely discussed it with anyone.
"A lot of that I blocked out of my memory. I almost never talk about my Vietnam experience other than to say, 'I was there,' even to my family," he said.

NO ILL WILL
A former North Vietnamese soldier, Ho Van Minh heard about the American combat troop withdrawal during a weekly meeting with his commanders in the battlefields of southern Vietnam.
The news gave the northern forces fresh hope of victory, but the worst of the war was still to come for Minh: The 77-year-old lost his right leg to a land mine while advancing on Saigon, just a month before that city fell.
"The news of the withdrawal gave us more strength to fight," Minh said Thursday, after touring a museum in the capital, Hanoi, devoted to the Vietnamese victory and home to captured American tanks and destroyed aircraft.
"The U.S. left behind a weak South Vietnam army. Our spirits was so high and we all believed that Saigon would be liberated soon," he said.
Minh, who was on a two-week tour of northern Vietnam with other veterans, said he bears no ill will to the American soldiers even though much of the country was destroyed and an estimated 3 million Vietnamese died.
If he met an American veteran now he says, "I would not feel angry; instead I would extend my sympathy to them because they were sent to fight in Vietnam against their will."
But on his actions, he has no regrets. "If someone comes to destroy your house, you have to stand up to fight."

A POW'S REFLECTION
Two weeks before the last U.S. troops left Vietnam, Marine Corps Capt. James H. Warner was freed from North Vietnamese confinement after nearly 5 1/2 years as a prisoner of war. He said those years of forced labor and interrogation reinforced his conviction that the United States was right to confront the spread of communism.
The past 40 years have proven that free enterprise is the key to prosperity, Warner said in an interview Thursday at a coffee shop near his home in Rohrersville, Md., about 60 miles from Washington. He said American ideals ultimately prevailed, even if the methods weren't as effective as they could have been.
"China has ditched socialism and gone in favor of improving their economy, and the same with Vietnam. The Berlin Wall is gone. So essentially, we won," he said. "We could have won faster if we had been a little more aggressive about pushing our ideas instead of just fighting."
Warner, 72, was the avionics officer in a Marine Corps attack squadron when his fighter plane was shot down north of the Demilitarized Zone in October 1967.
He said the communist-made goods he was issued as a prisoner, including razor blades and East German-made shovels, were inferior products that bolstered his resolve.
"It was worth it," he said.
A native of Ypsilanti, Mich., Warner went on to a career in law in government service. He is a member of the Republican Central Committee of Washington County, Md.

A DIFFERENT RESPONSE
Chief Warrant Officer 5 Duane Johnson, who served in Afghanistan and is a full-time logistics and ordnance specialist with the South Carolina National Guard, said many Vietnam veterans became his mentors when he donned a uniform 35 years ago.
"I often took the time, when I heard that they served in Vietnam, to thank them for their service. And I remember them telling me that was the first time anyone said that to them," said Johnson, of Gaston, S.C.
"My biggest wish is that those veterans could have gotten a better welcome home," the 56-year-old said Thursday.
Johnson said he's taken aback by the outpouring of support expressed for military members today, compared to those who served in Vietnam.
"It's a bit embarrassing, really," said Johnson. "Many of those guys were drafted. They didn't skip the country, they went and they served. That should be honored."

ANTI-WAR ACTIVISM
John Sinclair said he felt "great relief" when he heard about the U.S. troop pull-out. Protesting the war was a passion for the counter-culture figure who inspired the John Lennon song, "John Sinclair." The Michigan native drew a 10-year prison sentence after a small-time pot bust but was released after 2 ? years ? a few days after Lennon, Stevie Wonder and others performed at a 1971 concert to free him.
"There wasn't any truth about Vietnam ? from the very beginning," said Sinclair by phone from New Orleans, where he spends time when he isn't in Detroit or his home base of Amsterdam.
"In those times we considered ourselves revolutionaries," said Sinclair, a co-founder of the White Panther Party who is a poet, performance artist runs an Amsterdam-based online radio station. "We wanted equal distribution of wealth. We didn't want 1 percent of the rich running everything. Of course, we lost."
The Vietnam War also shaped the life of retired Vermont businessman John Snell, 64, by helping to instill a lifetime commitment to anti-war activism. He is now a regular at a weekly anti-war protest in front of the Montpelier federal building that has been going on since long before the start of the wars in Afghanistan and Iraq.
The Haslett, Mich., native graduated from high school in 1966 and later received conscientious objector status. He never had to do the required alternative service because a foot deformity led him to being listed as unfit to serve.
"They were pretty formative times in our lives and we saw incredible damage being done, it was the first war to really show up on television. I remember looking in the newspaper and seeing the names of people I went to school with as being dead and injured every single week," said Snell, who attended Michigan State University before moving to Vermont in 1977.
"Things were crazy. I remember sitting down in the student lounge watching the numbers being drawn on TV, there were probably 200 people sitting in this lounge watching as numbers came up, the guys were quite depressed by the numbers that were being drawn," he said. "There certainly were people who volunteered and went with some patriotic fervor, but by '67 or'68 there were a lot of people who just didn't want to have anything to do with it."

Even so, good feng shui means truly feeling comfortable and in tune with your living space. Surround yourself with artwork or decorations that are inspirational to you to encourage good energy. If you?re thinking about painting the walls, make sure you unify the color and theme with the room at large, accommodating the existing color of your furniture or making changes accordingly to fit your new color template.

WASHINGTON (AP) ? It would seem a lobbyist's dream: rounding up votes for a proposal backed by more than 8 in 10 people in polls. Yet gun control supporters are struggling to win over moderate Democrats in their drive to push expanded background checks for firearms purchasers through the Senate next month.
Backed by a $12 million TV advertising campaign financed by New York Mayor Michael Bloomberg, gun control groups scheduled rallies around the country Thursday aimed at pressuring senators to back the effort. President Barack Obama was meeting at the White House with gun violence victims.
Moderate Senate Democrats like Mark Pryor of Arkansas and Heidi Heitkamp of North Dakota are shunning Bloomberg as a meddling outsider while stressing their allegiance to their own voters' views and to gun rights. While saying they are keeping an open mind and that they support keeping guns from criminals and people with mental disorders, some moderates are avoiding specific commitments they might regret later.
"I do not need someone from New York City to tell me how to handle crime in our state. I know that we can go after and prosecute criminals without the need to infringe upon the Second Amendment rights of law-abiding North Dakotans," Heitkamp said this week, citing the constitutional right to bear arms.
Heitkamp does not face re-election next year, but Pryor and five other Senate Democrats from Republican-leaning or closely divided states do. All six, from Southern and Western states, will face voters whose deep attachment to guns is unshakeable ? not to mention opposition from the still-potent National Rifle Association, should they vote for restrictions the NRA opposes.
"We have a politically savvy and a loyal voting bloc, and the politicians know that," said Andrew Arulanandam, spokesman for the NRA, which claims nearly 5 million paying members.
The heart of the Senate gun bill will be expanded requirements for federal background checks for gun buyers, the remaining primary proposal pushed by Obama and many Democrats since 20 first-graders and six women were shot to death in December at an elementary school in Newtown, Conn. Senate Democratic leader Harry Reid of Nevada has said there aren't enough votes to approve a ban on assault weapons, while prospects are uncertain for a prohibition on large-capacity ammunition magazines.
Today, the background checks apply only to sales by the nation's roughly 55,000 federally licensed gun dealers. Not covered are private transactions like those at gun shows and online. The Senate measure is still evolving as Sens. Chuck Schumer, D-N.Y., Joe Manchin, D-W.Va., and Mark Kirk, R-Ill., use Congress' two-week recess to negotiate for additional support in both parties.
Expanding background checks to include gun show sales got 84 percent support in an Associated Press-GfK poll earlier this year. Near-universal background checks have received similar or stronger support in other national polls.
Polls in some Southern states have been comparable. March surveys by the Quinnipiac University Polling Institute found more than 9 in 10 people in Florida and Virginia backing expanded background checks, the same margin found by an Elon University Poll in North Carolina in February.
Analysts say people support more background checks because they consider it an extension of the existing system. That doesn't translate to unvarnished support from lawmakers, in part because the small but vocal minorities who oppose broader background checks and other gun restrictions tend to be driven voters that politicians are reluctant to alienate.
"It's probably true that intense, single-issue gun voters have been more likely to turn out than folks who want common-sense gun laws," said Mark Glaze, director of Mayors Against Illegal Guns, the group that Bloomberg helps lead. Glaze, however, said he believes that voters favoring gun restrictions have become more motivated since Newtown and other recent mass shootings.
Several moderate Democrats are holding back as they assess the political landscape. They're also waiting to see exactly what the Senate will consider.
Sen. Mark Begich, D-Alaska, said Wednesday his state's voters tell him, "Don't take away our rights, our individual rights, our guns." Begich said he opposes a strict proposal requiring background checks for nearly all gun sales but will wait to see whether there is a bipartisan compromise he can support.
The problems faced by gun control supporters go beyond the challenge of winning over moderate Democrats. GOP opponents are sure to force Democrats to get 60 of the Senate's 100 votes to win, and there are only 53 Democrats plus two independents who generally support them.
Also targeted by Bloomberg's ads are 10 Republicans, including Sen. Jeff Flake of Arizona, home of ex-Rep. Gabrielle Giffords, who was severely wounded in a mass shooting; the retiring Sen. Saxby Chambliss of Georgia; and moderate Sen. Susan Collins of Maine.
In another indicator of hurdles facing gun control forces, the Senate voted 50-49 last week to require 60 votes for any legislation narrowing gun rights. The proposal lost because 60 votes in favor were required, but six Democrats voted for the proposal, offered by conservative Sen. Mike Lee, R-Utah.
"It confirms there's no such thing as an easy gun vote," said Jim Kessler, a senior vice president of the centrist Democratic group Third Way.
Underscoring the uncertainty about moderate Democrats:
?Sen. Mark Warner, D-Va., is "still holding conversations with Virginia stakeholders and sorting through issues on background checks" and proposals to ban assault weapons and high capacity ammunition magazines, spokesman Kevin Hall said.
?Pryor said of Bloomberg's ads: "I don't take gun advice from the mayor of New York City. I listen to Arkansans." Spokesman Michael Teague said Pryor opposes universal background checks but could favor expanding the requirement to gun show sales.
?Sen. Kay Hagan, D-N.C., told the Greensboro News & Record she favors expanded background checks, but said her vote would depend on the measure's details. Sen. Joe Donnelly, D-Ind., answered, "Yes," when the Fort Wayne Journal Gazette asked whether he supports gun show background checks ? prompting Bloomberg's group to remove Donnelly's name from the ad they are running in Indiana.
The gun bill also increases penalties for illegal gun sales and slightly boosts aid for school safety.
More abrupt changes like an assault weapons ban generally get slight majorities in polls. Democratic leaders decided to omit it from the Senate bill because such a provision lacks enough votes.

Rene Ritchie at iMore reported the iPhone 5S is coming in August. Ritchie has excellent sources at Apple. He was one of the first to report what the iPad Mini would look like. He was also first to report Apple was going with a smaller cable for the iPhone. He nailed the announcement and release date of the iPhone 5.
In addition to Ritchie's report of an August release, Jefferies analyst Peter Misek said he's hearing Apple pushed the release of the iPhone 5S from June to the July-September time frame because it was having some manufacturing issues.
Based on Ritchie's excellent track record, plus the shift from Jefferies, we're now expecting a new iPhone in August.
The iPhone 5S isn't expected to be a big upgrade over the iPhone 5. Ritchie says it will look the same with some internal improvements and a camera upgrade.

ROME (Reuters) - A state prosecutor urged Italy's top court on Monday to overturn the acquittal of American Amanda Knox and a former boyfriend for the murder of British student Meredith Kercher.
Kercher's half-naked body, with more than 40 wounds and a deep gash in the throat, was found in the apartment she shared with Knox in Perugia in 2007.
The Court of Cassation, Italy's final court of appeal, is due to decide on Monday or Tuesday whether to start the process for a retrial or to uphold the 2011 verdict and close the case definitively.
"In this trial the judge lost his way," state prosecutor Luigi Riello told the court, urging it to accept the request for an appeal from Perugia prosecutors and Kercher family lawyers, who say the verdict was flawed and left central aspects of the case unexplained.
Both Knox's lawyer Luciano Ghirga and Giulia Bongiorno, a lawyer for Knox's former boyfriend Raffaele Sollecito, said they were confident the court would uphold the verdict clearing their clients of murder.
Prosecutors accused Knox and Sollecito of killing Kercher in a drug-fuelled sexual assault. They were initially found guilty and sentenced to 26 and 25 years in prison respectively after a trial that grabbed headlines all over the world.

"We all still miss Meredith terribly," her sister Stephanie said in a statement on Monday. "A beautiful young girl, my little sister, was taken from us far too soon in such a brutal way with too many unexplained factors."
Monday's ruling, which will be made on procedural issues, not on questions of merit, could be the last development in a case whose initial handling was sharply criticised by independent forensic experts.
"There seems to be very little criticism of the technical aspects of the trial," said Ghirga.
Prosecutors last year filed a motion to appeal against the acquittals, calling the verdict "contradictory and illogical".
Francesco Maresca, a lawyer representing Kercher's family, said in a statement on Monday the acquittals had been "defective" and "lacked transparency".
"There was a lot of external pressure and the judge showed a will from the start to acquit," Maresca said.

If the Court of Cassation upholds the request and decides to go back to trial, new hearings will be held at a later date.
However, Bongiorno said there was little room for the decision to be challenged.
"We have a verdict behind us that is so well-grounded, coherent and logical that we're very calm," she said as she entered the court.
Italian law permits prosecutors to appeal against not guilty verdicts. The Court of Cassation will decide whether there were any procedural irregularities that give grounds for a retrial, rather than examining the facts of the case.
Knox and Sollecito were acquitted after the independent forensic investigators challenged police scientific evidence.
A third man, an Ivorian drifter named Rudy Guede, was found guilty and sentenced to 16 years in a separate trial. He is now the only person serving time for the murder, although prosecutors say he could not have killed Kercher by himself.
Kercher, a student at Leeds University, was 21 when she died.
Knox, dubbed "Foxy Knoxy" in many early media reports, was initially portrayed as promiscuous and dishonest but a lobbying campaign by her family helped change perceptions.
She returned to her Seattle-area home after she was released from prison in Italy and is scheduled to speak publicly about the trial for the first time on American television in April, when her book of memoirs is also due to be released.

The Senate?s vote-a-rama began shortly before 4 p.m. Friday, as former pre-school teacher Patty Murray warned her senatorial pupils about wandering off the floor.
?You leave at your own peril,? she said, the chairman of the Senate Budget Committee and master of these ceremonies.
Plenty wandered off anyway. The marathon voting session came, after all, on the eve of a two-week congressional recess and in the midst of the second night of March Madness basketball.
Even Sen. Mitch McConnell, the GOP leader who has mercilessly chastised Democrats for failing to put a budget on the floor for four years, admitted to splitting his attention between the floor proceedings and his home-state Western Kentucky Hilltoppers. ?Sen. McConnell cheering on #WKU from the U.S. Capitol tonight in between #budget votes. #GoTopps!? his office tweeted during the game. (They lost 57-64 to No. 1-ranked Kansas.)
Senators? shoulders slumped, tempers flared and Harry Potter even made a cameo in the congressional record as the voting dragged into the early Saturday hours.
As each roll call vote was taken, senators streamed from the sanctuary of their separate cloakrooms to cast votes for nonbinding budget amendments that ranged from the Keystone pipeline (backed by 62 senators, including 17 Democrats) to a carbon tax (overwhelmingly defeated) to instituting stricter sales tax collections on Internet purchases (it, too, passed).
By 6:30 in the evening, the second floor of the Capitol smelled of barbeque. A buffet was dished out in McConnell?s office, as Republican senators traipsed back and forth from the floor holding paper plates piled high with meat, cornbread, baked beans and salad.
For a while, Sen. Elizabeth Warren, D-Mass., decamped to a quiet hallway off the floor, whipping out her laptop to catch up on work. She was sure to return to the floor as the Senate took up a measure to express the chamber?s displeasure with federal subsidies for ?too big to fail? banks. There was no opposition but members wanted a recorded vote anyway.
It passed 99-0 and clapping erupted -- a big Senate no-no -- in the well of the chamber. Sen. Kirsten Gillibrand, D-N.Y., pointed blame at Sen. Claire McCaskill, D-Missouri. ?It was Schumer,? McCaskill pleaded innocently. (Both she and Schumer had clapped.)
Sen. Ron Wyden, D-Oregon, thumbed through an iPad on the floor during one of many recorded tallies, perhaps unaware that one of Senate Republicans? favorite talking points in recent months has been that the iPad didn?t exist the last time Senate Democrats passed a budget.
At least he wasn?t making any noise. The volume on the floor kept steadily growing as Murray asked the chair to restore order. Around 10 p.m., Murray declared, ?I know there is alot of March Madness going on but I?d like to keep calm on the floor.? The chamber quieted briefly before returning to the mood and noise level of a cocktail party, befitting the late Friday night hour.
Even the leaders of the Senate budget warring -- Republican Sen. Jeff Sessions of Alabama and Murray -- stood together and laughed, at times. Just weeks earlier, Sessions had accused Murray of insinuating that he disliked poor people during a budget ?hearing related to welfare and food stamps.
Gillibrand was spotted showing off Friday?s New York Times, which featured a front-page story about the growing clout of women in the Senate. She flipped and pointed her colleagues to the story?s jump page, which just so happened to feature a prominent color photo of her. Meanwhile, Sen. Orrin Hatch, R-Utah, sat in his chair, reading a hardcover book in his newish black-framed hipster glasses.
Around 11 p.m., Senate Majority Leader Harry Reid came to the floor to praise the evening?s progress. ?We?re doing fine,? he said. ?We?re not at carnival stage yet. Let?s proceed and try to reach this with a lot of dignity.?
None of these late-night votes had any chance of making it into law. Instead, this marathon session was all about setting policy precedents and scoring political points ahead of the 2014 mid-term elections, when the Republicans hope to take back the Senate.
Senators loosened further as the clock ticked past midnight. Sen. Tom Harkin, D-Iowa, rose to oppose an amendment that defunded, in some way, a part of the president?s health care law, likening the GOP effort to tossing ?Harry Potter?s invisibility cloak? over the legislation. The amendment, one of multiple attempts to chip away at the health care?law during the vote-a-rama, failed by a voice vote.
Good humor was in shorter-supply around 1:30 a.m., as Republicans continued to demand more votes. ?Reid pulled off his glasses and rubbed his eyes during one exchange between Murray and Sessions. Murray pleaded with Republicans to consider the Senate?s ?elderly? members.
The amendments continued unabated.
By 3 a.m., Reid and Murray demanded that senators, like unruly schoolchildren, stay seated in their desks to speed up the process.
Republicans obliged, happy to be having their say on the floor, no matter the time.
"This," declared McConnell past 4:30 a.m., "is one of the Senate's finest days in recent years."
The world's greatest deliberative body was about to pass a budget without a single vote to spare.

President Obama weighed in once again in the fight over guns. In his weekly address, the president said each of his proposals to reduce gun violence should get a vote in Congress, including a ban on assault weapons. NBC's Lester Holt reports.

A $12 million television ad campaign paid for by Mayors Against Illegal Guns hopes to push gun control efforts including comprehensive background checks.
New York City Mayor Michael Bloomberg, the group's co-chair, announced the ad buy Saturday. The New York Times reported Bloomberg is financing the campaign.
?I don?t think there?s ever been an issue where the public has spoken so clearly, where Congress hasn?t eventually understood and done the right thing," Bloomberg told NBC News' David Gregory in an interview that will be broadcast Sunday on ?Meet the Press.?
The ads will target both Democratic and Republican senators in key states.
One of the ads portrays a middle-aged man sitting on the back of a pick-up truck and holding a rifle.
"I've owned a gun all my life and I'll fight for my right to keep it," the man says. "Background checks have nothing to do with taking guns away from anyone," he adds.
The ad urges viewers to tell Congress to vote in support of comprehensive background checks. There is no mention in the ad of an assault weapons ban, but Bloomberg told Gregory he still hopes Congress could pass one.
?We?ve been fighting since 2007 to get a vote. We are going to have a vote on ? for sure ? on assault weapons and we?re going to have a vote on background checks," he said.
"And if we were to get background checks only it wouldn?t be as good as if we got both, but we demanded a plan and then we demanded a vote. We?ve got the plan, we?re going to get the vote.?

BAGHDAD (AP) ? Secretary of State John Kerry says he was sorry to learn that the leader of the Western-backed Syrian opposition coalition has resigned, but that it won't affect the U.S. effort to try to force Syrian President Bashar Assad to step down.
Mouaz al-Khatib (moo-AZ' al-khah-TEEB'), the leader of the Syrian National Coalition, announced his plans Sunday, citing what he called insufficient international support.
Kerry, who made an unannounced visit to Iraq on Sunday, says the U.S. will continue to work with opposition leadership on the delivery of aid. Kerry told reporters that such a transition in such an opposition group inevitable and that Khatib's departure doesn't change U.S. policy. Kerry said the fight is about, quote, "an opposition that is bigger than one person and that opposition will continue."
